These terms govern your use of malcolmrealestate.com. By using the site you accept them. They do not affect your rights as a tenant or applicant, which come from your lease and from Virginia law, not from this page.

Who operates this site

Malcolm Real Estate, a real estate firm licensed in the Commonwealth of Virginia, firm license #0226020452, with offices in Ashland and Fairfax.

Listing information

We take care to keep listings accurate, but rents, availability, dimensions, features, and photographs are provided for general information and may change without notice. Square footage and room dimensions are approximate. Photographs may show a similar unit, a previous furnishing, or a different season.

Nothing on this site is an offer to lease, and nothing on it creates a tenancy. A tenancy begins only when a written lease is signed by all parties. Before you rely on any detail — the rent, the pet policy, whether utilities are included — confirm it with us in writing.

A listing may be withdrawn, and an application may be declined or an acceptance rescinded, at any time before a lease is signed.

Using the site

You agree not to:

• Submit false information, or apply in someone else's name without their authority
• Attempt to gain access to any part of the site or its data that is not intended for you
• Scrape, harvest, or bulk-copy listings or contact details
• Interfere with the operation of the site, or introduce anything harmful to it
• Use the site for any unlawful purpose

Applications

The rental application asks for personal and financial information. What we do with it is described in our privacy policy. The standards we apply are on our rental criteria page.

You are responsible for the accuracy of what you submit. A material misstatement is grounds for declining the application, or for terminating a lease already signed.

The application fee is disclosed before you pay it, and is not requested until after an initial review of your submitted application.

Electronic signatures and records

By signing an application electronically you agree that your electronic signature has the same effect as a handwritten one, and that we may keep records of the transaction electronically.

You may ask for a paper copy of anything you signed. Tell us and we will provide it.

Links to other sites

Where we link to another site, we do not control it and are not responsible for its content or its privacy practices.

Content and trademarks

The Malcolm Real Estate name and logo, and the text, photographs, and design of this site, belong to us or are used with permission. You may view, download, and print pages for your own use in considering a home. Any other reproduction or commercial use needs our written permission.

Disclaimer and limits

The site is provided as it is. We do not warrant that it will be uninterrupted, error-free, or free of anything harmful, and we do not warrant that every detail on it is accurate or current.

To the extent Virginia law permits, we are not liable for indirect or consequential losses arising from your use of the site. Nothing in these terms limits any liability that cannot lawfully be limited, including our obligations to you as a tenant under the Virginia Residential Landlord and Tenant Act, or our duties as a licensed real estate firm.

Governing law

These terms are governed by the law of the Commonwealth of Virginia, and the courts of Virginia have jurisdiction over any dispute arising from them.

Changes

We may update these terms. The date at the top of this page shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
